A very small number of divorce cases are tried to the court or jury. Almost every case is resolved by settlement. Cases which are difficult to settle will be ordered to mediation before the court will hear the trial. Mediation is a process by which the mediator goes back and forth between the parties and their lawyers and assists in reaching a voluntary agreement.
